Pedestrian accidents

When a pedestrian is struck, the consequences can extend well beyond the scene. We help injured people understand a possible claim and their next steps.

Being injured while walking can interrupt ordinary routines immediately. Medical treatment, time away from work, and changes in mobility may create questions that are difficult to handle alongside recovery. You may also be unsure how an insurer will assess what happened.

National Justice Partners can review the circumstances with you. We can discuss the available information, identify questions about responsibility, and explain whether a personal injury claim may be appropriate.

Reconstructing the collision

The location and movements of everyone involved matter. A review may consider a turning vehicle, a driveway or parking area, a crossing, traffic controls, lighting, and a driver’s ability to see the pedestrian. The circumstances should be examined rather than inferred from a single photograph.

A driver, an employer, or another party may be relevant depending on the facts. Crashes involving an unidentified or uninsured driver can raise additional insurance questions. We can discuss which information is needed to evaluate the incident and potential coverage.

Evidence and the effects of injury

Records from the scene can help explain the event, while medical and financial records show its impact. If available, keep:

  • Police report details and the names of witnesses or responding agencies.
  • Photographs showing the crossing, roadway, traffic signals, and vehicle damage.
  • Medical records, bills, and recommendations for further treatment or assistance.
  • Records of missed work and changes to travel, household tasks, or daily activities.

Nearby camera footage may also be useful, but it may not remain available indefinitely. Let us know if you believe a business, vehicle, or property camera recorded the collision. There is no need to risk your safety by returning to the roadway to gather evidence.

Where to begin

Prioritize medical care and follow the advice of your treating professionals. Save insurer letters and messages, keep a record of claim numbers, and organize the documents you receive. A family member can help with these tasks if the injury makes them difficult.

At an initial consultation, share when and where the incident happened and what you remember. We can start that conversation even if the investigation is ongoing or you are waiting for records. Which losses can be pursued depends on the evidence and applicable law.
